RAMENDRA JAIN, J. (ORAL) Case has been taken up for hearing through video-conferencing due to Covid-19 pandemic.

Through instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner - Sat Narain - in case arising from FIR No.41 dated 05.02.2019 registered under Section 20 of the Narcotic Drugs and Psychotropic Substances, 1985 at Police Station Jhajjar, Jhajjar.

According to the prosecution, on 05.02.2019, petitioner was apprehended with conscious possession of 8 kgs 100 grams charas, without any permit or license.

Learned counsel inter alia contends that petitioner has falsely been implicated in this case. He is in custody since 05.02.2019. Conclusion of trial may take a sufficient long time. -2CRM-M-21929 of 2020 by detaining the petitioner in jail any more. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner - Sat Narain - is ordered to be released on bail during pendency of trial, if not required in any other case, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
