Mr. Ranjan Lakhanpal, Advocate for the petitioner **** SURYA KANT, J. (Oral) (1) Notice of motion. On our asking, Mr. Vaibhav Sharma, DAG Punjab accepts notice on behalf of the State of Punjab. (2) The petitioner who was a Sub Inspector in the Punjab Police and has been dismissed from service on account of his involvement in some criminal cases including under the NDPS Act, seeks pre-arrest bail in case FIR No.69 dated 16.04.2013, under Sections 21/61/85 NDPS Act and 420/467/468/471 IPC at Police Station Fatehgarh Sahib.
(3) It has been averred in the petition and is very fairly stated by learned counsel for the petitioner also that he has been declared a 'proclaimed offender'.
(4) In this view of the matter, while we are satisfied that no case to grant pre-arrest bail is made out and the petitioner's prayer qua that relief is accordingly declined, however, if the petitioner surrenders and thereafter applies for regular bail, we direct the learned Special Court to consider his bail application sympathetically and decide the same within one week.
