The petitioner has been attributed a grievous injury on the head of the complainant.

Counsel for the petitioner has submitted that the MLR is indicative of the fact that the report is a procured report. Besides this, it has been argued that statement of the injured was not recorded on 3rd or 4th of September, 2014 despite the fact that he was fit for making a statement. In view of the grievous injury having been attributed to the petitioner, counsel for the petitioner does not press this petition and seeks permission to withdraw the same with liberty to approach the court concerned for seeking relief u/s 439 Cr.P.C.
