The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for the issuance of directions upon the official respondents to conduct fair and impartial investigation in case FIR No. 124 dated 26.6.2025, under Sections 85, 316(2) and 61(2) of BNS, registered at Police Station Dasuya, District Hoshiarpur. 2.
Mr. Gursharnjit Singh Chanota, Advocate puts in appearance on behalf of respondent No. 6 and files his power of attorney, which is taken on record.

Learned State counsel while placing reliance on the status report filed by way of an affidavit of Superintendent of Police, PBI, District Kapurthala, submits that during further investigation, one representation No. 1272-SSP dated 07.8.2025 has been filed by Paramjit Kaur qua the innocence of the present petitioners i.e. Bawa Singh, Surinder Kaur and one Rajinder Kaur, which was forwarded to the Superintendent of Police, PBI,
-2Narcotics, District Hoshiarpur for further investigation. It is further submitted that during further investigation, accused Bawa Singh, Surinder Kaur and Rajinder Kaur were declared innocent, and a recommendation for deletion of Section 61(2) of BNS in the present FIR was made. Subsequently, after the approval of the Senior Superintendent of Police, District Hoshiarpur, the above persons were declared innocent and vide DDR No. 24 dated 31.10.2025, Section 61(2) of BNS was deleted. Learned State counsel further submits that in compliance with the directions issued by the Deputy Inspector General, Jalandhar Range, Jalandhar, further investigation in the present FIR was being conducted by the Superintendent of Police, PBI, District Kapurthala.
During such investigation, both the parties were informed telephonically to appear before the said officer on 07.02.2026. However, only respondent No. 6 appeared in person, while the petitioners failed to appear personally and instead sent their respective witnesses, whose statements were recorded. Thereafter, letter dated 03.04.2026 was issued to the petitioners and one Rajinder Kaur and Charanjit Singh, directing them to appear before the Investigating Officer. In pursuance thereof, the petitioners appeared before the concerned officer. However, only petitioner No. 2-Surinder Kaur got recorded her statement, whereas the statement of petitioner No. 1 is yet to be recorded. It has also been submitted that the above proceedings have been carried out in furtherance of the investigation with regard to the present FIR. 4.
From a perusal of the status report(s) and the foregoing discussion, it is evident that the investigation in the present case is still ongoing, and various procedural steps are being undertaken by the investigating agency to bring the matter to its logical conclusion.

In view of the aforesaid facts and circumstances, and without expressing any opinion on the merits of the case, this Court is of the considered opinion that no interference is called for at this stage, particularly when the investigation is still in progress.

Accordingly, the present petition is disposed of with a direction to the Superintendent of Police, PBI, District Kapurthala to conclude the investigation expeditiously and within a time bound manner, in accordance with law.

Pending miscellaneous application(s), if any, also stands disposed of.
