Instant petition has been filed under Section 528 of BNSS, seeking quashing of the below detailed First Information Report (FIR), and all the consequential proceedings arising therefrom, on the basis of the compromise dated 05.04.2025(Annexure P-2), effected between the parties. DETAILS OF CRIMINAL CASE:- FIR No.

On 04.09.2025, following order was passed:

'CRM-28331-2025 For the reasons mentioned in the application, the same is allowed. Affidavit dated 03.05.2025 of complainant/respondent No.2 (Annexure P-3) is taken on record subject to all just exceptions. Main Case Petitioners, who are accused in case bearing FIR No.0029 dated 31.01.2025 registered against them at Police Station Division No.7, District Ludhiana, for commission of offence punishable under Sections 304, 115(2), 126(2), 351, 324(4), 3(5) of BNS (Annexure P-1), have prayed for quashing of the aforesaid FIR and all the proceedings arising

CRM-M-21814-2025 (O&M) -2therefrom, on the basis of compromise dated 05.04.2025 (Annexure P-2). Learned counsel for the petitioners submits that all the parties to the dispute, have amicably resolved their dispute through the aforesaid compromise. Therefore, if proceedings arising from the aforesaid FIR, and all the consequential proceedings arising therefrom, are quashed, all the parties and their family members will be able to live their lives peacefully. Notice of motion. On asking of the Court, Mr. Kamalpreet Bawa, DAG, Punjab, who is present in the Court, accepts notice on behalf of respondent No.1- State. Mr. Vishnu Dutt, Advocate has filed power of attorney on behalf of respondent No.2, which is taken on record. He admits factum of compromise.

CRM-M-21814-2025 (O&M) -2- Concerned parties are directed to appear before the learned Trial Court/Illaqa Magistrate, on 20.10.2025, for getting their respective statements recorded with regard to the compromise. Thereupon, the concerned Court shall submit a detailed report, containing the information on the following points, along with copies of the statements to this Court, well before the adjourned date:- Sr.

In compliance of the order dated 04.09.2025, report is received from the learned Judicial Magistrate 1st Class, Ludhiana, wherein it has been stated that none of the parties have appeared before the Court for recording their statements on 11.11.2025, 18.11.2025, 11.12.2025, 22.12.2025, 14.01.2026 and 16.01.2026. 4.

In view thereof, this Court finds that parties are not in agreement, due to which they have not appeared before the learned Judicial Magistrate 1st Class,Ludhiana for recording their respective statement qua the factum of compromise. Hence, in the given circumstances, no purpose would be served by keeping pending the present petition.

The present petition thus, stands dismissed.
