The petitioners through the instant petition under Articles 226/227 of the Constitution of India are seeking setting aside of Award dated 27.02.2008 (Annexure P-1) whereby Labour Court has answered the reference in favour of the workman.

Counsel for the parties are ad-idem that workman was reinstated and thereafter regularized. He has superannuated. 3.
The dispute is confined to back wages. The Labour Court has awarded 50% back wages with continuity of service. 4.
Mr. Sandeep Thakan, Advocate for the workman submits that he may be granted continuity of service.

Ms. Harsh Rekha Kapoor, AAG, Haryana submits that workman may not be granted back wages.

In the wake of statement of both sides, the petition stands disposed of with the modification of impugned Award to the extent that workman would not be entitled to back wages, however, would be entitled to continuity of service as granted by Labour Court.
