The petitioner has filed this petition under Section 438 Cr.P.C. for giving directions to the arresting/investigating officer to release the petitioner on bail in the event of his arrest in case FIR No.41 dated 25.7.2015 registered for the offences under Sections 420, 494 and 120-B IPC at Police Station Kalanaur, District Gurdaspur. Notice of motion has been issued in this case. Mr. P.S. Grewal, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.
I have heard learned counsel for the petitioner and learned Deputy Advocate General, Punjab appearing for the respondent-State and have gone through the record.
The petitioner has already joined the investigation in HARPAL SINGH PARMAR 2016.02.08 16:41 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-44128 of 2015 [2] compliance with the interim order dated 24.12.2015 passed by this Court. He is not required for custodial interrogation. It has been brought to my notice that the matter has already been compromised and a copy of compromise deed has already been placed on record as Annexure-P.3. Learned counsel for the petitioner also argued that a petition has already been filed in this Court for quashing of above said FIR on the basis of compromise.
Keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find merit in this petition and the same is allowed. The interim order dated 24.12.2015 passed by this Court granting interim bail to the petitioner is made absolute. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C. February 4, 2016.
