The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.05 dated 27.1.2016 registered for the offences under Sections 302, 307 read with Section 34 IPC and Sections 25, 27 and 29 of the Arms Act at Police Station Jhander, District Amritsar.

I have heard learned counsel for the petitioner and have gone through the record.

As argued by the learned counsel for the petitioner, present petitioner has been summoned under Section 193 Cr.P.C. by the trial Court. I have gone through the FIR. As per the FIR, petitionerKulwinder Singh alias Kinder alias Kinda was armed with a revolver and he brought out revolver from his pocket and fired on father of complainant Harpal Singh Parmar 2017.02.14 16:33 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-4422 of 2017 [2] with an intention to kill him, which hit on left side of his forehead, resulting which his father collapsed on the ground. It is also in the FIR that Kulwinder Singh alias Kinder alias Kinda fired another shot on the complainant with an intention to kill him, which fire hit on left side of his abdomen. The Police during investigation has found Kulwinder Singh alias Kinder alias Kinda innocent, but a perusal of the FIR shows that Kulwinder Singh alias Kinder alias Kinda is the main accused. Keeping in view the facts and circumstances, I do not find it a fit case where the present petitioner is entitled to the benefit of anticipatory bail.

Therefore, finding no merit in this petition, the same is dismissed.
