Petitioner is seeking implementation of order dated 10.01.2007, Annexure P-8 and for granting benefit of Military service to him from 15.01.1965 to 26.06.1974 for the purposes of pensionary benefits, on account of the fact that he has already deposited the amount of gratuity as required, however, neither has the needful been done nor any order denying the same, a fact not controverted in the counter filed by the respondents. 2.

In view of the aforesaid, learned State counsel, on instructions, states that the respondents would take a decision on the claim in accordance with law.

Without commenting upon the merits of the case, the petition is hereby disposed of with a direction to the respondents to decide the claim of the petitioner, expeditiously as per rules and if the petitioner is found entitled, grant the benefit forthwith.
