Learned counsel for the petitioner seeks to withdraw this petition with liberty to file a fresh one on the same cause of action if the petitioner can find any substance at all to show that the respondent perjured himself before this Court in any manner, by filing CWP-PIL No.109 of 2020.

It is to be noticed that the said petition came up for hearing before a Division Bench of this Court on 04.09.2020 with the following order passed by their Lordships:- "With the consent of learned counsel for both the parties, the matter is being taken up and heard via video conferencing.

Learned counsel for the petitioner prays for and is permitted to withdraw the petition with liberty to file a detailed representation before the respondent-authorities which may be considered and decided in accordance with law.

Dismissed as withdrawn with the liberty aforesaid."

It is of course to be noticed that learned counsel for the petitioner has argued that in fact the signatures on the said petition do not seem to be that of the respondent as per his other signatures available with the university (he being a former employee of the university and there being other litigation also pending between them).

Upon query to him that if the petition was filed by some other person other than the respondent, and in any case with nothing pointed out to this Court even in the petition, as to what facts have been mis-stated before this Court, he has sought to withdraw the petition, to file one with better particulars if they become available.

Dismissed as withdrawn with the aforesaid liberty. [It is also to be observed that this Court had given the option to learned counsel to deposit pre-litigation costs as the respondent is seen to be a 72 year old man (as per the memo of parties). Upon that observation made the aforesaid statement for withdrawal of the petition with liberty to file a fresh one has been made by him.
