Gurtej Singh v. State Of Punjab
In the High Court of Punjab and Haryana, at Chandigarh Criminal Misc. No. M-44237 of 2017 Date of Decision: 22.11.2017 Gurtej Singh ... Petitioner(s)
Versus
State of Punjab ... Respondent(s) CORAM: Hon'ble Mr. Justice Shekher Dhawan.
Present:
Mr. Narinder Singh Pawar, Advocate for the petitioner(s).
Shekher Dhawan, J.
Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 329 dated 16.10.2017, registered under Section(s) 353, 186, 506 & 34 IPC at Police Station City Sangrur, District Sangrur.
The allegations against the petitioner are that on 15.10.2017 at about 11.40 p.m., petitioner along with Ajay Kumar entered into the police station and scuffled with Head Constable Pawan Kumar, torn his uniform and used criminal force against him and prevented him from discharging his official duty. Learned counsel for the petitioner stated that petitioner has been falsely implicated in the case as he had just gone to the police station to inquire about some detenue.
In view of the allegations levelled against the petitioner in the FIR, no case is made out to grant the concession of pre-arrest bail to him and hence, present petition stands dismissed.
