Prayer in this petition, filed under Section 482 of the BNSS, 2023 (earlier Section 438 Cr.P.C.), is for grant of anticipatory bail to the petitioner, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:- Name of Petitioner (s) FIR No. Date Section(s) Police Station District Ramandeep Singh @ Ramna 28.03.2025 109, 115(2), Talwandi Sabo Bathinda 191(3), of BNS, 2023 and Section 25, of Arms Act, 2.
Learned State counsel has filed reply dated 20.04.2025 in the Court today and the same is taken on record.

Counsel for the petitioner argues that the allegation against the petitioner- Ramandeep Singh Alias Ramna is that he is armed with pistol and fired twice towards the car of Gora Singh and Satnam Singh. However, said bullets neither hit any car nor to any person including the complainant. He also submits that, had the allegation been truthful, the bullets and empties would have been recovered from the spot. There is no such evidence available with the prosecution. 4.
On the other hand, Mr. Vinay Kumar Malhotra, DAG, Punjab while appearing for the State on instructions from ASI Des Raj is unable to counter the arguments addressed by the petitioner. 5.
In view of above, the prayer made in the present petition is worth considerable. Petition is allowed and petitioner is directed to join investigation within a period of three weeks from today or as and when called by the Investigating Officer and in the eventuality of the arrest, petitioner would be released on ad-interim bail, subject to his furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioner shall also be abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.

Besides, it is directed that petitioner would hand over his passport to the Investigating Agency or to Court concerned, if he possesses. Otherwise, would submit an affidavit, disclosing the fact that he does not possess any passport.
It is also directed that before leaving country any time during trial, petitioner would seek prior permission of the Court.

However, petitioner shall continue to join the investigation as and when required to do so and abide by all the terms and conditions laid down under Section 482(2) of BNSS, 2023. 8.
Accordingly, petition stands disposed of.
