(ORAL) Prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to petitioner Joginder Singh Lather in case FIR No.112 dated 04.10.2017 registered under Sections 323, 342, 506 and 34 IPC at Police Station G.R.P. Hisar.

Learned counsel for the petitioner submits that no recovery has to be effected from the petitioner. False case has been registered against the petitioner. According to the MLR of the complainant, injury allegedly attributed to the petitioner is under Section 323 IPC, however, Section 506 IPC has been added to make the offence non-bailable. Heard.

There are specific allegations against the petitioner and his coaccused that they were in drunken condition and gave beatings to the complainant. No ground for grant of anticipatory bail to the petitioner is made out.

Dismissed.
