M.M.S. BEDI, J (ORAL) Petitioner himself has suffered a grievous injury. He as a member of an unlawful assembly has also been attributed injury with sword on the right hand of Khazan Singh. Co-accused of the petitioner have been granted the concession of regular bail. It will be debatable during trial as to which of the parties was aggressor. Whether the injuries attributed to the petitioner are on account of self defence or it is a case where the petitioner has exceeded the right of self defence will also be debatable at trial. The petitioner himself having received total five injuries and having joined investigation can be granted the concession of pre-arrest bail.
The petition is allowed. It is ordered that interim order dated 24.12.2014 will remain operative subject to the petitioner joining investigation as and when required.
