On asking of the Court, Mr. Kiran Pal Singh, AAG, Haryana accepts notice on behalf of the State.

C.W.P No. 12121 of 2019 The present petition is for issuance of direction to the respondents to release the salary of the petitioner along with 18% interest. On 08.05.2019, this Court passed the following order:- Learned counsel submits that the petitioner was promoted to the post of TGT (Sanskrit), vide order dated 05.09.2018 (P-1) and she joined on the post on 14.09.2018 (P-2) but she has not been paid salary till date despite the fact that Principal has written letters to the BEO Hisar List (P-3 colly) Notice of motion for 16.07.2019.

Learned counsel has relied upon judgment of Hon'ble the Supreme Court of India in a case of S.K. Dua vs. State of Haryana and another, 2008 (1) SCT 618 and judgment of Madhya Pradesh High Court in a case of B. Thirumoorthy vs. Secretary to Government, Highways Department, Fort St. George, Chennai-600009 and others, 2017 (4) CTC 146 wherein direction was issued to the employer to pay interest at 10% p.a to petitioner for delayed payment of salary.

In view of the above factual position, the present petition stands disposed of with a direction to the respondents to decide the legal notice dated 20.04.2019 and pass speaking orders. The respondents shall release the salary of the petitioner along with 10% interest, within a period of two months from the date of receipt of certified copy of this order.
