It is, inter alia, contended by learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in this case. He contends that the petitioner was neither present at the place of occurrence nor participated therein. The petitioner does not have any criminal
-2antecedents and is in custody since long and the conclusion of trial will take sufficient long time. Thus, prays for grant of concession of bail to the petitioner.

Per contra, learned State counsel while referring to the short reply filed by the State has opposed the petition on the ground that there are specific allegations against the petitioner of having given gunshot injury killing Baljeet Singh in the occurrence. He submits that the instant case involves triple murder and the petitioner has actively participated in the crime along with his father Virsa Singh, who had given gunshot injuries killing Harbhajan and Amrik Singh, as such, prays for dismissal of the petition.

Heard learned counsel for the parties and perused the record. 5.
After considering the rival contentions and perusing the record, it is observed that the instant case was registered on the statement given by complainant Vikram Singh to the effect that his father are four brothers, doing agricultural work separately. They purchased some land out of which some land was purchased by one Virsa Singh resident of their Village. On 13.11.2020 at about 11:30 AM, the complainant along with his father Amrik Singh and uncle Harbhajan Singh and cousin Baljeet Singh were ploughing their fields. At that time, Virsa Singh armed with 12 bore double barrel rifle gun and his son Robinpreet Singh armed with datar, and Paramjit Kaur and Harpreet Kaur armed with dandas came there. The father of the complainant Amrik Singh tried to pacify them but Virsa Singh started firing his rifle, hitting Amrik Singh and Harbhajan Singh due to which they fell down on
-3the ground and died at the spot. Thereafter, the petitioner took the rifle from his father and started firing on them hitting Baljeet Singh and uncle Kundan Singh. Later the assailants ran away from the spot and the injured were shifted to hospital, where Baljeet Singh succumbed to the injuries. 6.
A perusal of the record would reveal that there is specific attribution to the petitioner of having committed murder of Baljeet Singh by directly firing from his rifle after taking the rifle from his father Virsa Singh. The said Virsa Singh had earlier fired upon Amrik Singh and Harbhajan Singh killing them at the spot. The petitioner is actively involved in murder of three persons.

Therefore, in these circumstances, considering the serious nature and gravity of offence involved, the petitioner is not entitled to the concession of bail at this stage. Accordingly, the present third petition for grant of bail to the petitioner is dismissed. 8.
