The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.51 dated 3.6.2016 registered for the offences under Sections 302, 307, 323, 148 and 149 IPC read with Sections 25, 27 and 29 of the Arms Act, 1959 at Police Station Raja Sansi, Amritsar, District Amritsar.

Notice of motion has been issued in this case. Mr. Pawan Sharda, learned Senior Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner as well as learned State and have gone through the record. Learned counsel for the petitioner stated that the petitioner has already appeared before the trial Court and he has been released on interim HARPAL SINGH PARMAR 2018.11.22 15:39 I attest to the accuracy and authenticity of this document Chandigarh

From the record, I find that the present petitioner has been summoned by the Court under Section 319 Cr.P.C. The present petitioner was earlier found innocent and now has been summoned by the Court under Section 319 Cr.P.C.

The petitioner has already appeared before the trial Court in compliance with the order dated 11.10.2018 passed by this Court granting interim bail and he has been released on bail by the trial Court. The petitioner has only to face the trial. No useful purpose will be served by sending the petitioner to custody.

Keeping in view the facts and circumstances of the present case; I find merit in this petition and the same is allowed. The interim order dated 11.10.2018 passed by this Court granting interim bail to the petitioner is made absolute.
