Naresh Kumar Sanghi, J.(Oral) Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of regular bail to the petitioner, Nanak Singh @ Nanku, who has been booked for having committed the offence punishable under Section 18 of the Narcotic Drugs and Psychotropic Substances Act, 1985, in a case arising out of FIR No.38, dated 24.03.2014, registered at Police Station, Bahaw Wala, District Fazilka.

Learned counsel for the State submits that it is highly improbable for the Investigating Agency to implant more than 5 kg of opium on the appellant for his false implication in the present case. He further contends that appellant is involved in yet another case arising out of Narcotic Drugs and Psychotropic Substances Act, 1985.

After hearing the learned counsel for the parties and going through the contents of the petition and keeping in view the fact that more than 5 kg of opium of commercial quantity was recovered from the petitioner, no ground of bail is made out. Dismissed.
