MANJARI NEHRU KAUL, J. (ORAL) Prayer in this petition is for grant of anticipatory bail to the petitioners in case FIR No.18 dated 21.02.2024 under Sections 454, 380, 448, 506, 511, 34 of the IPC registered at Police Station Bhupani, District Faridabad.

While issuing notice of motion on 07.05.2024, following submissions of learned counsel for the petitioners were recorded:- "Learned counsel for the petitioners inter alia contends that it is a matter of record that a civil suit already stood instituted by the petitioners in October, 2023 qua the property in question, in which status quo had been ordered by the Civil Judge (Jr. Divn.), Faridabad (Annexure P-2) on 20.11.2023, however, the FIR in question was registered at the instance of the complainant on 21.02.2024 alleging that the petitioners had PUNEET SACHDEVA 2024.09.03 12:57 I attest to the accuracy and integrity of this document Chandigarh
CRM-M-22800-2024 -2demolished the building (school) which earlier stood on the land in question and had then sold off all the articles inside it. Learned counsel has submitted that thus it is evident for reasons but obvious, the FIR in question had been lodged by the complainant."

Thereafter, vide order dated 21.05.2024, the petitioners had been granted interim anticipatory bail with direction to join investigation.

Learned counsel for the petitioners submits that in compliance of order dated 21.05.2024, the petitioners have joined investigation and cooperated with the investigating agency. 5.
Learned State counsel, on instructions, does not dispute the factum of the petitioners having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioners are not required for further investigation much less for their custodial interrogation.

In view of the above, the petition is allowed and interim order dated 21.05.2024 is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
