(ORAL) Through this petition under Section 438 Cr.P.C. prayer has been made for grant of anticipatory to the petitioner in case FIR No.0179 dated 15.08.2017 registered under Sections 341, 427, 379B, 511, 148 and 149 IPC at Police Commissionerate Ludhiana, P.S. Model Town.

Petitioner, on regular bail, is facing trial in the aforesaid FIR before the learned Additional Sessions Judge, Ludhiana. However, on account of some unavoidable circumstances, he was unable to appear before the trial Court. Consequently, he got moved exemption application through his counsel, which, the trial Court rejected vide impugned order dated 01.10.2018 (Annexure P-4) and petitioner was ordered to be summoned through non-bailable warrants, cancelling his bail and surety bonds. Heard.

-2CRM-M-45274 of 2018 Application of the petitioner seeking exemption from his personal exemption has been rejected on the ground that same was not supported by affidavit.

Considering overall facts and circumstances, petitioner is directed to appear before the trial Court within a week or on the date fixed and shall be released on bail, subject to his furnishing fresh bail and surety bonds to the satisfaction of the trial Court. Disposed of.
