This is petition under Section 439(2) Code of Criminal Procedure seeking cancellation of anticipatory bail granted to respondent No.2 vide order dated 07.05.2015 (Annexure P-5) passed in CRM-M40967-2014 by this Court in case FIR No.93 dated 27.03.2014 registered for the offences punishable under Sections 419, 420, 467, 468, 471 read with Section 120-B of Indian Penal Code at Police Station Civil Lines, District Amritsar City.

Learned State counsel submits that this petition has been rendered infructuous as respondent No.2 absented from the trial Court. Her bail bond and surety bond were cancelled and she has since been declared proclaimed offender.

Respondent No.2 was allowed anticipatory bail vide order SACHIN MEHTA 2019.11.06 14:49 I attest to the accuracy and authenticity of this document High Court, Chandigarh

CRM-M-44277-2015 -2dated 07.05.2015. Thereafter, challan was filed and during trial, respondent No.2 has absented. Anticipatory bail allowed to respondent No.2 was only till the filing of the challan and due to her absence and living abroad without permission of the Court, she is not entitled to get any benefit of bail either anticipatory or regular, if allowed, on the basis of order allowing her anticipatory bail.

Keeping in view the conduct of respondent No.2, order dated 07.05.2015 passed in CRM-M-40967 of 2014 is withdrawn and this petition is allowed accordingly.
