M.M.S. BEDI, J (ORAL) Petitioners are father-in-law and mother-in-law of Sandeep Kaur wife of Kaptan Singh who had committed suicide as her husband had allegedly illicit marital relations with Bimaljit Kaur. State counsel has opposed the application on the ground that a similar application filed by Kaptan Singh has been dismissed by this Court.

After hearing the counsel for the petitioners and going through the record, it appears that the main allegations are against son of the petitioners. The allegation against the petitioners is that they had conspired with their son and had allegedly given an expression regarding their intention to remarry their son. They have already joined investigation. It does not appear to be case of custodial interrogation.

CRM-M-44426-2014 (O&M) Petition is allowed. It is ordered that in case of arrest of the petitioners they will be released on bail to the satisfaction of the arresting officer subject to the conditions that they will join investigation as and when required and will not tamper with the evidence or hamper investigation, in any manner.
