Petitioner-Chamkaur Singh has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail in case FIR No.80 dated 04.08.1999, registered at Police Station Lohian, District Jalandhar,

I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. CRM-M-45252-2016 " From the record, I find that 30 kg of poppy husk was recovered from the petitioner. It is also evident that during the course of proceedings, the petitioner was declared 'proclaimed offender' vide order dated 22.11.2001 and now the petitioner himself surrendered before the Court on 29.09.2016. It is also evident that the petitioner had left for Italy without taking any permission from the Court Keeping in view the aforesaid discussion, I do not find it a fit case, where the petitioner is entitled to benefit of regular bail. Moreover, there is every apprehension that the petitioner may again abscond from the Court proceedings, if he is enlarged on bail. Therefore, finding no merit in the petition, the same is dismissed.
