(Oral) The instant petition has been filed by the complainant seeking cancellation of bail as granted to respondent No.3/accused in respect of FIR No. 0027, dated 07.02.2017, Police Station Sadar Kurali, District SAS Nagar (Mohali), under Sections 323, 325, 341, 148, 149 IPC (Sections 308, 201 and 34 IPC added later on).
At the time of grant of anticipatory bail by this Court, the main offence against respondent No.3/accused was under Section 308 IPC. CRM-M-22232-2020 (O&M) - 2 - Court has also granted bail to the respondent/accused in respect of offence under Section 307 IPC.
In view of the aforestated position, the instant petition filed for cancellation of bail in respect of offence under Section 308 IPC has been rendered infructuous particularly keeping in view the fact that a separate petition for cancellation of bail granted in respect of offence under Section 307 IPC has already been instituted in this Court wherein notice of motion had already been issued.
Disposed off accordingly.
