Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.114 dated 12.08.2016 under Sections 406/498A IPC registered at Police Station Adampur, District Jalandhar. The parties were directed by this Court on 19.12.2016 to appear before the Mediation and Conciliation Centre of this Court. Learned counsel for the petitioner submits that the entire dispute between the petitioner and respondent No.2 has been settled amicably. The terms and conditions of the settlement were reduced into writing on Omkar Singh 2017.02.16 11:42 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-45274 of 2016 [2] 16.01.2017 though not before the Mediation and Conciliation Centre of this Court. A copy of this compromise was produced before the Mediator on 21.01.2017. The parties have decided to part ways. A petition under Section 13B of the Hindu Marriage Act has been filed and statements at first motion have been recorded on 16.01.2017. Certified copies of the same have been produced in Court today, which are taken on record subject to just exceptions. It is further submitted that a demand draft of `15,000/- has been deposited with the Registry of this Court. The petitioner has joined investigation in terms of order dated 19.12.2016 passed by this Court. Therefore, this petition be allowed.
Ms. Ramneeq Kaur, learned counsel for respondent No.2 affirms and verifies the factum of settlement between the parties as well as filing of the petition under Section 13B of the Hindu Marriage Act. In view of the facts and circumstances as noted above but without commenting or expressing any opinion on the merits of the case, this petition is allowed. Consequently, order dated 19.12.2016 is made absolute. Registry is directed to release the demand draft of `15,000/- deposited by the petitioner to respondent No.2. ( LISA GILL ) February 14 , 2017.
