Present:

Mr. Anterpreet Singh, Advocate for the petitioner. HARINDER SINGH SIDHU, J Present petition has been filed seeking directions to respondent Nos.2 & 3 to protect life and liberty of the petitioner at the hands of respondent Nos.4 & 5.

Respondent Nos.4 & 5 are accused in FIR No.45 dated 22.02.2019 under Sections 420,120-B IPC and Section 82 of Registration Act registered at P.S Division No.7, District Ludhiana. The FIR was registered on the complaint of the petitioner and one other person who had since died. Thus, he is now sole surviving complainant in the afore-stated FIR.

Respondent No.4 had filed petition for grant of anticipatory bail, which was dismissed by the learned Addl. Sessions Judge, Ludhiana vide order dated 02.03.2021. Both respondent Nos.4 & 5 have also been declared as proclaimed offenders. The petitioner claims that respondent Nos.4 & 5 are threatening to eliminate him if he does not withdraw the complaint/FIR filed against them. In this regard, the petitioner has submitted a representation dated 17.06.2021 (P.4) addressed amongst others to respondent No.2 wherein he has specifically given instances of threats MANOJ KUMAR 2021.07.15 10:10 I attest to the accuracy and integrity of this document

CRWP No.6451 of 2021 #2# being extended by respondent No.4. Despite the said representation and inspite of respondent Nos.4 & 5 having been declared as P.Os, they are roaming freely and no action is being taken by the official respondents. Notice of motion.

Mr. Sarabjit Singh, Assistant Advocate General, Punjab has accepted notice on behalf of State of Punjab. Without commenting upon the merits of the case or opining on the veracity of the allegations contained in the representation, this petition is disposed of with a direction to respondent No.2 to look into the grievance of the petitioner, as raised by her in the representation (P.4) and take appropriate action, in accordance with law.
