The present petition has been filed under Section 438 Cr.P.C., for grant of anticipatory bail to the petitioners, in DDR No.35 dated 29.09.2022 under Sections 323, 324, 341, 148, 149 IPC (Section 326 IPC added later on) at P.S. Dirba in case FIR No.117 dated 28.09.2022 registered under Sections 323, 325, 336, 506, 148, 149 IPC and Sections 25, 54, 59 of Arms Act at Police Station Dirba, District Sangrur.
Vide order dated 10.05.2023, petitioner was granted the concession of interim bail in the following terms:- "Learned counsel for the petitioner inter alia submits that the present is a case of version and cross-version and the aggressor shall be determined during trial as both the parties including the petitioner and the complainant have suffered injuries." Learned counsel for the petitioner states that pursuant to order dated 10.05.2023, passed by this Court, the petitioner has joined the investigation. Learned State counsel on instructions from Darshan Singh states that the petitioner is no longer required for further interrogation. In view of the above, the petition is allowed and interim order dated 10.05.2023, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
