(Oral) Present petition has been filed by the petitioner for seeking direction to respondent No.2 to decide the representation (Annexure P-1) and take action against the accused persons in case FIR No.210 dated 28.10.2015, under Sections 342, 365, 376D, 506 IPC Sections 5G and 6 of the Protection of Children from Sexual Offence Act, 2012, at Police Station Hassanpur, District Palwal.

Learned State counsel has filed reply by way of an affidavit on behalf of respondent Nos.1 to 4, today in the Court, stating therein that after registration of FIR, the prosecution was got medico-legally examined in GH Palwal and the statements under Section 161 Cr.P.C. were got recorded by the investigating officer. CRM-M-44371-2015 (O&M) -2Magistrate and recorded her statement under Section 164 Cr.P.C. where she has fully corroborated the allegations levelled by the petitioner against the accused. During investigation, accused Mustfa was arrested on 03.02.2016. The report of FSL is still awaited and sincere efforts are going on to arrest the remaining accused.

Learned State counsel, on instructions from HC Harkesh, has informed that the challan in the present case has been presented on 20.09.2016 and out of total 23 witnesses, 2 witnesses has been so far. In view of above facts, no further action is required to be taken, at this stage and the present petition is disposed of by giving liberty to the petitioner to approach the respondents-State in case he apprehending any threats from the accused, in accordance with law.
