***** RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to the petitioner, in case, FIR No.0260 dated 16.03.2018, under Sections 406 and 420 IPC, Police Station Chandni Bagh, District Panipat.

According to the prosecution, the petitioner while working as Senior Officer of Ad-Accounts Department with the complainant, embezzled the amount of `62,12,324/-.

Learned counsel contends that there is 08 months' delay in lodging the FIR. No amount, date or period of embezzlement is disclosed while lodging the FIR. Investigating Officer has even not collected the audit report. Since, last 13 months, the police has not taken any action. The petitioner was not working on the seat, where money transaction used to take place.
