Cr. Misc. No.M-44530 of 2014 [2] The present petitioner has been summoned under Section 319 Cr.P.C. to face trial for the offences under Sections 354-A and 506 IPC and Section 12 of the POCSO Act. The main allegations are against coaccused Ashok Kumar. The petitioner has already surrendered before the trial Court in view of the interim order dated 1.1.2015 and has been released on bail. He is not required for custodial interrogation. The trial of the case will take long time and the petitioner is only to face the trial. No useful purpose will be served by sending the petitioner to custody. Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find merit in this petition and the same is allowed. The interim order dated 1.1.2015 passed by this Court is made absolute.
