This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No. 73 dated 25.08.2017 under sections 353, 186, 436, 427, 148, 149, 120-B, 188 IPC, sections 3 & 4 of the Prevention of Damage to Public Property Act, 1984, section 3, 4 of the Explosive Substances Act, 1908 at Police Station Sadar Budhlada district Mansa. It has been urged before the court that petitioner name did not figure in the FIR. He has been named in the statement of one of the accused. Admittedly, investigation has been completed and challan presented. Thus, no useful purpose would be served by detaining the petitioner in custody during the pendency of trial. Without expressing any opinion on the merits of the case, this court feels that petitioner deserves to be enlarged on bail. Accordingly, petition is allowed and petitioner is directed to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate Mansa and/or any other condition(s) as it may deem fit to impose.
