The petitioner seeks the concession of pre-arrest bail in a case registered at the instance of Gaurav Sharma alleging that he is married to Neha d/o Devinder Singh. The petitioner had been sending objectionable messages to the complainant and his wife. FIRs have been registered in Delhi and Jalandhar but the petitioner did not mend himself and threatened the complainant on phone to withdraw cases otherwise he would throw acid on his wife.

Counsel for the petitioner submits that regarding the same allegations FIRs have been registered at Jalandhar (Annexure P-2) and Delhi (Annexure P-3). The conduct of the petitioner would not warrant grant of pre-arrest bail to him but in view of the fact that he has been booked for the same allegations at different places, indulgence can be shown by striking a balance between the right of the petitioner for liberty and the right of the complainant of privacy and peaceful living. The petitioner, pursuant to the interim order, has already joined the investigation. He has already handed over his phone and passport to the Delhi Police. Cr. Misc. M 44419 of 2015 -2The petition is allowed and it is ordered that in case of arrest of the petitioner, he will be released on bail to the satisfaction of the arresting officer subject to the condition that the petitioner will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation. The petitioner will not commit the similar offence, of which he is accused of, during pendency of the trial. He will also not threaten the witnesses. In case of violation of any of the above said conditions, this order will be liable to the cancelled.
