******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.177 dated 21.10.2017 registered for the offence punishable under Section 420 of Indian Penal Code, at Police Station Sadar Patti, District Tarn Taran.

Heard.

Learned State counsel on instructions from ASI Nirmal Singh submits that as per statement of Amarjit Singh, proprietor of M/s Gill Sales Corporation, Patti, an amount of `2,50,000/- was transferred by petitioner in his bank account towards payment of some kiryana grocery purchased from his shop. M/s Gill Sales Corporation is not a travel agency. He further submits that as per investigating officer, petitioner was go between complainant and travel agent, who was relative of petitioner. CRM-M-44505 of 2017 -2transaction. It is alleged that another amount of `20,000/- was paid in cash. The person, who is alleged to be a travel agent, has not been arrayed as accused so far.

Keeping in view above facts but without expressing any opinion on the merits of the case, this petition is allowed and order dated 27.11.2017 is made absolute till the presentation of challan, subject to the following terms:- (i) that the petitioner shall make himself available for interrogation by the police as and when required; (ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) that the petitioner shall not leave India without the prior permission of the Court.

(iv) that the petitioner will seek regular bail on the presentation of challan in Court.
