The petitioner being a member of an unlawful assembly had allegedly entered the house of the complainant Jasvir Singh. The petitioner along with two others pelted stones, broke windows and left the place when an alarm was raised. Motive attributed to the petitioner is that the complainant's son and the petitioner have some money dispute. Counsel for the complainant has intervened to oppose the petition contending that the house of the complainant was ransacked and motor cycle was also taken away.

I have heard counsel for the parties and gone through the police file. It appears that there is no allegation of theft or extortion but it is an attempt of assault, in which no injury has been suffered by any one. The petitioner having joined the investigation, can be granted the concession of pre-arrest bail.

Accordingly, the petition is allowed and interim order dated 1.1.2015 is hereby confirmed and it is ordered that in case of arrest of the petitioner, he will be released on bail to the satisfaction of the arresting officer subject to the condition that he will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation.
