ASHOK KUMAR VERMA, J. (ORAL) Prayer in this petition filed under Section 482 Cr.P.C. is for issuance of directions to respondents No. 2 to 4, for registration of case under Section 304-A IPC and other relevant sections with regard to death of son of the petitioner, namely, Aman Kumar, who died during treatment after suffering injuries in an accident and despite there being ample evidence against the culprits, the police being hand in gloves with them neither registered any FIR, nor has taken any action on the complaint filed by the petitioner.
Reply dated 13.12.2022, filed by way of affidavit of Sh. Swarndeep Singh, Senior Superintendent of Police, Jalandhar (Rural), on behalf of respondents No. 1 to 4, is taken on record. It has been averred in the aforesaid reply that on the complaint of petitioner-Rama Rani, FIR No. 134 dated 22.11.2022 under Sections 304-A, 279, 337, 338 and 427 IPC (Section 201 IPC was added RISHU KATARIA 2022.12.14 12:41 I attest to the accuracy and authenticity of this order/judgment
CRM-M-24894-2022 -2later on) was registered at Police Station City, Nakodar, Jalandhar (Rural) against Jaskaran Singh S/o Manjeet Kumar resident of Dherian, Police Station City, Nakodar, District Jalandhar. It has further been averred that the delay has been caused in lodging the aforesaid FIR due to negligence in duty by ASI Balwinder Singh and Inspector Aman Saini, the then SHO, Police Station City, Nakodar and show cause notices dated 27.09.2022 and 09.12.2022, have been issued to them as why departmental proceedings should not be initiated against them. In view of the above facts mentioned in the reply, no further action is required to be taken in the instant petition and the same stands disposed of, accordingly.
