ARUN MONGA, J. (ORAL) Petitioner herein, inter alia, seeks issuance of a writ in the nature of mandamus directing the respondents to get his disability assessed in terms of Rule 143 of Haryana Civil Services (General) Rules, 2016 and accord him benefit of extension of service in accordance thereof.

Petitioner is currently working as Deputy District Attorney at Haryana Police Academy and is due to retire on 30.06.2022 on attaining the age of 58 years. While in service and he was found to be suffering from hearing impairment with 62% disability. Petitioner informed the department vide letter dated 11.01.2018 and requested for his medical examination for the purpose and give him extension in service, as is provided to the persons with disabilities pertaining to Group A and B officers.

Qua his aforesaid grievance, petitioner submitted representation dated 30.03.2022 followed by another representation dated SHALINI BHATIA 2022.06.01 19:56 I attest to the accuracy and authenticity of this Judicial Record/ Decree/ Document, which is scanned copy of the original\
04.05.2022 (Annexure P-6) but the same have not been adverted till date. Hence, the petition.

On advance service, learned State counsel appears and submits that a decision will be taken by competent authority, either way, on the representation dated 04.05.2022 (Annexure P-6) by passing a speaking order.

At this stage, learned counsel for the petitioner also seeks decision on the pending representation, as suggested by learned State counsel.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the instant writ petition is disposed of with a direction to the respondents to look into the representation dated 04.05.2022 (Annexure P-6) of the petitioner and pass an administrative order, in accordance with law, as expeditiously as possible.

Till decision is taken on the representation dated 04.05.2022 (Annexure P-6), the petitioner shall be allowed to continue working on his current post.

Disposed of accordingly.
