(Oral) Learned counsel for the petitioner submits that he has instructions from the petitioner to vacate the premises and at the maximum he can vacate the same within a period of one week and makes prayer to withdraw the present revision petition.

The said offer is acceptable to learned counsel for the respondent, but however, he makes a submission that the said possession will be taken without prejudice to the rights of the parties to be adjudicated, with regard to the rate of rent, payment/non-payment of arrears of rent (if any) and also with regard to the user of the common passage. In view of the submission, so made by learned counsel for the petitioner, which is acceptable to learned counsel for the respondent, the present revision petition is hereby dismissed as withdrawn, with the direction to the petitioner to vacate the premises and hand over the possession of the same by 15.12.2023.
