On 31.07.2023, this Court had passed the following order:- "xx xx Learned counsel contends that though the petitioner was named in the FIR but during investigation, he was found innocent and was put in column No.2 of the final report. However, on an application filed under Section 319 Cr.P.C., he has been summoned as an additional accused. The petitioner is a resident of Rajasthan and serving as Head Constable. There is no evidence that any amount came into his account or call record of having spoken to the deceased on mobile. The petitioner is ready and willing to join the proceedings.

Adjourned to 14.09.2023.

The petitioner is directed to appear before the trial Court on or before 07.08.2023 and furnish his bail/surety bonds. On his doing so, he shall be released on interim bail, subject to the satisfaction of trial Court/Duty Magistrate concerned."

Learned counsel submits that in pursuance of aforesaid order, the petitioner surrendered before the trial Court and has been granted bail vide order dated 05.08.2023, which is taken on record as Mark A. 3.

Learned State counsel on instructions affirms the aforesaid factum. 4.
