M.M.S. BEDI, J (ORAL) Misc. application is allowed. Copy of report under Section 173 (2) Cr.P.C., is permitted to be taken on record. A perusal of the report indicates that there are general and vague allegations against the petitioner who happens to be unmarried sister-in-law of the complainant regarding the assault/demand. There is no allegation of any specific entrustment to the petitioner.

It has been informed by the counsel for the petitioner that charges have not yet been framed. It is always open to the trial Court to discharge the petitioner in case the allegations appear to be vague and uncertain not constituting prima facie any offence.

This petition is disposed of, at this stage, with liberty to the petitioner to raise all the pleas before the trial Court at the time RAJ KUMAR ARORA 2015.02.26 17:42 I attest to the accuracy and integrity of this document

It is observed that in case the arguments are raised on behalf of the petitioner before deciding the framing of charges, the trial Court shall pass a speaking order in context to the arguments raised.
