(ORAL) The short point involved in the present writ petition is while entertaining the application of respondent No.2, procedure prescribed under Section 18 of the Micro, Small and Medium Enterprises Development Act, 2006 has not been followed by respondent No.1 i.e. there was no conciliation proceedings. This Court noticed that no annexure in this regard appended except Annexure P-1 i.e. the order appointing empanelled Arbitrator. Learned counsel appearing on behalf of the petitioner submitted that aforementioned information was sought but it was turned down as entire record had been sent. Learned counsel for the petitioner seeks liberty of this Court for withdrawal of the writ petition with liberty to file a fresh one with better and more particulars.
