Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to refix the pay/pension of the petitioner after granting him the benefit of 3rd ACP on completion of 24 years of service and to release all consequential benefits including arrears of pay and pension along with interest @ 18% per annum from due date till its actual payment. 2.

Learned counsel for the petitioner, at the very outset, confines his prayer for deciding legal notice dated 01.03.2024 (Annexure P-4). He submits that at this stage, petitioner would be satisfied, if the said legal notice is decided by passing a speaking order within a time bound frame.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, this writ petition is disposed of with a direction to respondent No.2 to decide legal notice dated 01.03.2024 (Annexure P-4) expeditiously, submitted by the petitioner by passing a speaking order, preferably within a period of 03 months from receipt of certified copy of this order.
