RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner in a case arising from FIR No.479 dated 08.10.2018 registered under Section 15 of the Narcotic Drugs and Psychotropic Substances, 1985 at Police Station Pehowa, District Kurukshetra.

According to the prosecution, in the intervening night of 07.08.2018 petitioner was apprehended with conscious possession of 60.550 kilogram of choora post, which falls under the category of "commercial quantity".

Learned counsel for the petitioner inter alia contends that FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged recovery was a narcotic substance. Petitioner is in custody since 08.10.2018.

In view of above, but without expressing any opinion on the RAVINDER SINGH 2019.05.24 09:47 I attest to the accuracy and integrity of this document merits of the case, the petitioner is granted interim bail subject to furnishing
