(ORAL) Present petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.147 dated 25.04.2017, registered under Sections 406, 420, 467, 468, 471 and 120-B IPC, at Police Station Kundli, District Sonipat. It is contended by learned counsel for the petitioner that both the parties have settled the matter amicably and in this regard they have already made their statements before the trial Court. It is further contended that the report under Section 173 Cr.P.C. has already been submitted before the trial Court and the charges have been framed on 01.12.2017.

CRM-M-44625-2017 (O&M) -2Learned State counsel, on instructions from ASI Devender, has acknowledged the factum of compromise between the parties. In view of the fact that the parties have settled the matter and the final conclusion of trial is to take a long time, it would be just and appropriate if the concession of bail is granted to the petitioner. Moreover, the petitioner is in custody since 24.08.2017 and no useful purpose would be served by keeping him behind the bars. Therefore, in view of the abovesaid circumstances, without expressing any opinion on the merits of the case, this petition is accepted. Petitioner is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of the learned trial Court.
