(Oral) Quashing of FIR No. 249 dated 06.10.2009 under Sections 376/354/323/294 IPC (challan presented under Sections 354/323/294 IPC) registered at Police Station Jagraon, District Ludhiana, is being sought on the basis of compromise dated 28.01.2015 (Annexure P2). The allegations against the petitioner is that he blackmailed and outraged the modesty of the complainant. Petitioner kept one photograph of the complainant and started threatening her and thereafter, exploited her physically. When the petitioner started molesting the sister of the complainant, she lodged the present F.I.R.
However, the matter has now been duly compromised, vide compromise deed dated 28.01.2015 (Annexure P2). In compliance of order dated 14.07.2015, report of District and Sessions Judge, Ludhiana has been received in this regard. Crl. Misc. No. M-4500 of 2015 joint statement of the complainant and her sister was recorded to the effect that they have compromised the matter and the complainant does not want to proceed further against the accused and has no objection, if the present F.I.R be quashed against the petitioner. The compromise has been entered voluntarily. Statement of petitioner has also been recorded to the same effect.
Consequently, in view of the status report and in view of the judgment of the Hon'ble Supreme Court in the case of Dr. Arvind Barsaul etc. versus State of Madhya Pradesh and another 2008(2) RCR (Criminal) 910, no useful purpose would be served in prolonging the litigation. Accordingly, FIR No. 249 dated 06.10.2009 under Sections 376/354/323/294 IPC (challan presented under Sections 354/323/294 IPC) registered at Police Station Jagraon, District Ludhiana, is quashed along with all consequential proceedings arising therefrom qua petitioner. The petition stands disposed of.
