Through instant petition under Section 439 Cr.P.C., prayer has been made for grant of regular bail to petitioner-Vajinder Singh, in case FIR No. 84 dated 02.06.2020 registered under Section 21 of the NDPS Act at Police Station City, Khanna-II, District Ludhiana. According to the prosecution, petitioner was apprehended along with his co-accused with conscious possession of 280 grams of heroin wrapped in a polythene bag, without any permit or licence. Learned counsel for the petitioner inter alia contends that FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged recovery was a narcotic substance.
