Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in complaint case No. 138/3613 dated 20.07.2015 under Section 138 of the Negotiable Instruments Act, 1881. Learned counsel for the petitioner contended that petitioner had been regularly appearing before the learned trial Court and was admitted to bail, but it was cancelled on 08.02.2018 and non-bailable warrants of arrest were issued against him. Thereafter, proclamation proceedings were initiated against the petitioner on 13.04.2018, which are still pending. In view of above, no case is made out to grant the concession of pre-arrest bail to the petitioner and present petition stands dismissed. However, in case, petitioner surrenders before the learned trial Court within a period of one week from today and moves an application for granting him bail, the same shall be decided by the learned trial Judge within a period of one week, thereafter.
