******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of interim bail to the petitioner in case FIR No. 134 dated 12.02.2016 registered for the offence punishable under Section 18 of Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Civil Lines, District Karnal.
Heard.
The petitioner has sought interim bail for 8 weeks on medical ground alleging that he is suffering from Grade II Fatty Liver due to which he is having swelling and pain in left lower limb with fever alongwith other complications and urgently requires surgical intervention. CRM-M-44647-2017 -2Fresh Report of the Medical Officer, District Prison, Karnal received. As per report of no surgical intervention is recommended by the concerned specialist doctor of KCGMCH, Karnal and at this stage, the general condition of the U/T Prisoner is stable and his vitals are within normal limits. Along with the petition, I find no medical record of the petitioner stating that he requires immediate and urgent surgical intervention. For the health problem, he is being looked after in jail and was also referred to PGIMS, Rohtak for further management of his decease. Keeping in view the above fact, I find no reason to allow this application.
