Prayer in the present petition is for issuance of a writ in the nature of Habeas Corpus with a prayer for releasing the detenue, namely, Jyoti wife of the petitioner, confined by respondents No.4 to 6 in their illegal custody.

The petitioner and the detenue, namely, Jyoti are present in person in pursuance to the order dated 08.04.2026 passed by this Court. The Court has interacted with both of them. The detenue has apprised this Court that she is 22 years of age and being the age of majority, she voluntarily married with the petitioner on 06.10.2025. She further apprises the Court that after their marriage, she went to meet her parents, however, as they performed marriage against their wishes, her family members were not in favour of their marriage. She submits that the petitioner is her legally wedded husband and she wants to remain with her husband.

CRWP-4037-2026 -2both the petitioner and the detenue, namely, Jyoti are of the age of the majority and they are legally wedded as evident from Annexure P-1. The detenue desires to live with her husband. Hence, the present petition is disposed of and the detenue, namely, Jyoti is allowed to go with her husband i.e. the petitioner.
