Petitioner seeks the concession of pre-arrest bail in a case registered at the instance of Daljit Singh alleging that he had been duped by co-accused of the petitioner Satnam Singh and Tajinder Singh who had promised the complainant that on payment of a sum of Rs.24.50 lacs, his daughter Palak will be accommodated in Medical College at Faridkot or Amritsar.
Counsel for the petitioner has submitted that the main accused in the present case are in custody and that only allegation against the petitioner is that being known to the complainant, he had introduced him to Satnam Singh and Tajinder Singh but it was never suggested by the petitioner that the complainant should pay any money to anyone for getting admission
in Management Quota. It has also been submitted that the petitioner is known to one Gurvinder Singh who runs a shop adjoining the shop of the complainant as such, he knew the complainant. Pursuant to the interim order the petitioner has joined investigation. With the assistance of counsel for the petitioner and State counsel, I have gone through the police record in order to determine if the petitioner at any stage facilitated the crime by actual participation.
A perusal of the police file is indicative of the connivance of the petitioner with the co-accused as the Email pertaining to the date of counselling was sent by petitioner from his Email I.D. ranasingh828@gmail.com to co-accused Tajinder Singh who had further forwarded the same to the complainant. Counsel for the petitioner submits that said Email appears to have been sent by Tajinder Singh to one person holding the Email I.D. with name ranasingh.
The investigation conducted till date is indicative of the fact that it is the petitioner who holds the above said Email I.D. It will be premature to form an opinion that petitioner is not in any manner, connected with the crime which has been committed in connivance with Tajinder Singh and Satnam Singh or that petitioner does not have any connection with Tajinder Singh. No extra ordinary exceptional circumstances exist for the grant of pre-arrest bail to the petitioner.
The petition is dismissed. Nothing said in this order will prejudice the right of the petitioner to seek concession of regular bail on the basis of pleas taken up before this Court. (M.M.S. BEDI) February 19, 2016.
