(ORAL) Prayer in this petition is for grant of anticipatory bail in FIR No.286 dated 24.10.2019 under Sections 452, 427, 323, 341, 147, 149 IPC, registered at Police Station Sadar Amritsar, District Amritsar. Learned counsel for the petitioner relies upon the order dated 23.12.2019 passed in CRM-M-55436-2019, vide which interim anticipatory bail was granted to co-accused Vishal Bhaiya @ Vishal as well as the order dated 09.12.2019 passed in CRM-M-48749-2019, granting anticipatory bail to one another co-accused Manjot Singh @ Lara. It is submitted that in fact, it is a case of no injury and allegations against the petitioner are that he is part of an unlawful assembly. It is further submitted that even no injury is attributed to the petitioner except giving kick and fist blows. Notice of motion.

In virtual Court CRM-M-22145-2020 -2On asking of the Court, Mr. Joginder Pal Ratra, DAG, Punjab accepts notice on behalf of the respondent-State and has not disputed the factual position and submits that allegations against the petitioner are that he was part of an unlawful assembly and trespassed into house of the complainant and caused damage to the property.

After hearing learned counsel for the parties, without commenting anything on merits of the case and considering the fact that two co-accused of the petitioner have already been granted the concession of anticipatory bail, this petition is allowed and the petitioner is granted anticipatory bail subject to the conditions envisaged under Section 438 (2) Cr.P.C.
